Blue Cross of California dba Anthem Blue Cross Denied Costly Yet Medically Necessary Spine Surgery For a Los Angeles Man, Law Offices of Scott Glovsky Lawsuit Alleges

CLAREMONT, Calif., September 24, 2018 – Scott Glovsky of The Law Offices of Scott Glovsky filed a lawsuit in Los Angeles Superior Court on behalf of Joel Justice against Blue Cross of California dba Anthem Blue Cross for bad faith, unlawful business practices and breach of contract.
Anthem contracted to provide Joel with medically necessary health care in exchange for monthly premium payments. However, Anthem Blue Cross shirked its responsibility when Joel sought coverage for a medically necessary spinal fusion surgery which he needs to address the constant pain he lives with on a daily basis. It was after Joel has for years tried alternative treatments without success that Joel’s surgeon deemed it medically necessary to perform surgery on Joel’s spine. Despite Joel’s history and his surgeon’s recommendation for the medically necessary surgery, Anthem denied coverage claiming that the spinal fusion is not medically necessary.
It is Joel’s wish that through this case Anthem will accept responsibility for its actions, begin to reform its system and put in place policies that will assure that its members can access the medical treatment that they need in a timely fashion.
